These notes are intended to assist practitioners (Will & Trusts Writers), settlors (Clients providing the trust), and testators (Clients providing the Will) in the use of the STEP Standard Provisions. They are not, and cannot be, a substitute:
• as far as practitioners are concerned, for careful consideration of the appropriateness, in the circumstances, of each provision; and
• as far as testators and settlors are concerned, for reading all the provisions and for seeking further advice on any provision if unsure of its effect.
STEP standard & special provisions for Trusts. Fern Wills & LPAs will provide advice if any provisions do not seem appropriate after carefully listening to your needs. However, covering all potential outcomes without being too restrictive is impossible. For clients who do not want a detailed explanation of the Standard Provisions, it is sufficient to say: "This is the standard way of providing the executors with the technical and routine provisions they need to administer the estate properly. In particular, this authorises professional executors or trustees to charge for their work”.
